In order to provide you with better services, please carefully read the User Service Agreement (hereinafter referred to as "this Agreement"). Before using the products and services provided by Shanghai Jiuzhu Information Technology Co., Ltd, please carefully read this agreement - you should carefully read and fully understand the various terms of this agreement, especially the disclaimer clauses that exempt or limit the liability of ChatGenius, necessary limitations on your rights and information use, licensing, legal application, and dispute resolution clauses. Among them, important content such as exemption or limitation of liability clauses will be highlighted in bold for your attention, and you should focus on reading them.
Please carefully read and choose whether to accept or not to accept this agreement (minors should read with the legal guardian and obtain the consent of the legal guardian before using the services provided by the platform). When you read and agree to this agreement and start using the services provided by ChatGenius, it means that you have fully read, understood, and accepted all the contents of this agreement, and promise to be bound by this agreement as a party to it. During the process of reading this agreement, if you do not agree with the provisions of this agreement or any of its terms, you shall immediately cease to use the relevant services provided by ChatGenius.
We may update the content of this agreement from time to time according to the situation, but we will inform you through application announcements, private message notifications, or update prompts; Once this agreement is modified, it will replace the original service agreement. If you have any questions about the modified agreement, please contact us in a timely manner. If you do not agree to this agreement and/or any amendments or changes made by ChatGenius, please immediately stop using all services and/or products provided by ChatGenius.
Ⅰ、Definition
1、This agreement is entered into between you and the operator of ChatGenius, Shanghai Jiuzhu Information Technology Co., Ltd, and its affiliated companies (hereinafter referred to as the "Company"), regarding your downloading, installation, and use of ChatGenius, and obtaining the services provided by ChatGenius.
2、“"User" refers to all users who directly or indirectly obtain and use "ChatGenius" and related services, including natural persons, legal persons, or other organizations. In this agreement, it is referred to as "User" or "You".
Ⅱ、Introduction to Software and Services
1、"ChatGenius" is an artificial intelligence software that can provide you with services such as page information browsing, account registration, robot dialogue, and personalized chat robot creation. The specific services provided by "ChatGenius" shall prevail. Due to the nature of machine learning, feedback from "ChatGenius" on your input may not be unique among users. For example, you can input feedback such as "What color is grass?" and receive feedback such as "grass is green.". Other users may also ask similar questions and receive the same response.
2、 We grant you a non exclusive, revocable, non transferable, and non commercial legal right to use the "ChatGenius" software and services. When using "ChatGenius", you shall be responsible for any form of information and content you input in any way, including ensuring that it does not violate any laws, regulations, public order, good customs, socialist core values, or this agreement. "ChatGenius" may use the content you enter to provide and maintain services as needed, but only within the scope of compliance with laws and regulations.
3、If you have any feedback, opinions, ideas, proposals, or improvement suggestions regarding our services, we welcome and thank you for providing them to us. If you provide any of this information, we can use it without restriction and will not compensate you.
4、We have the right to charge fees for certain services related to "ChatGenius". You will make payment based on the prices and terms on the applicable pricing page, or as otherwise agreed in writing between us. Please pay attention to price changes. We do not guarantee any price changes, and any price changes will apply to fees charged to you immediately after the effective date of the changes. If you have any overdue fees, we may suspend your access and use of related services after notifying you.
5、To better enhance user experience and services, we will periodically provide updates or changes to the "ChatGenius" software and related services (including but not limited to software modifications, upgrades, feature enhancements, development of new services, software replacements, etc.). You have the right to choose to accept the updated version; If you choose not to update, some functions of "ChatGenius" may be restricted or cannot be used properly.
6、 We may develop different versions of application software for different terminal devices, and you should obtain, download, and install the appropriate version based on the actual device condition. If you did not obtain the "ChatGenius" software from Shanghai Jiuzhu Information Technology Co., Ltd or a third party authorized by Shanghai Jiuzhu Information Technology Co., Ltd, we cannot guarantee that the unofficial version of the software can be used normally. The losses you suffer as a result are not related to Shanghai Jiuzhu Information Technology Co., Ltd. If you no longer need to use the "ChatGenius" software and related services, you can also uninstall the corresponding application software yourself.
Ⅲ、Registration, Use, and Security of Accounts
1、Qualification for registration
(1) You should confirm that you are a natural person, legal person, or other organization with full capacity for civil rights and full capacity for civil conduct. Otherwise, you should register with the consent and guardianship of your guardian, and you and your guardian should bear all consequences arising from your improper registration behavior. If you are a child under the age of fourteen, you are not allowed to register under any conditions.
(2) For guardians, we specifically remind you that if your ward uses the "ChatGenius" software and related services, as a guardian, you should guide and supervise the ward's registration and use behavior. If your ward applies to register an account, we have the right to consider that they have obtained your consent.
2、Account registration
（1）Before the account registration is completed, "ChatGenius" will only provide you with partial services such as page browsing. You can choose to register by setting up a login phone number and completing verification, authorizing the use of third-party account associated registration, and other methods provided by "ChatGenius". After following the prompts on the registration page to fill in the information, reading and agreeing to this agreement and privacy policy, and completing all registration procedures, you can obtain a "ChatGenius" account.
（2）When you register through a certain form, "ChatGenius" will automatically generate an "account ID" for you. You understand and agree that when referring to your "ChatGenius" or account, it actually refers to the above account name, login phone number, authorized third-party account, or other information belonging to the "account" or "account". The account name you have set must not violate national laws and regulations, public order and good customs, social morality, use the name of others without permission, or easily confuse your identity with "ChatGenius". Otherwise, your account name may not be set successfully or we have the right to cancel it.
（3）You should accurately provide and timely update your account information in accordance with legal and regulatory requirements or the prompts on the corresponding pages, in order to make it true, timely, complete, and accurate. If the information you provide is incorrect, untrue, outdated, or incomplete, you shall bear the consequences and losses of not being able to register successfully, or your account being frozen, cancelled, or used.
（4）You can only register as a "ChatGenius" user through official channels. You are not allowed to obtain an account through means including but not limited to purchasing, renting, borrowing, sharing, utilizing or damaging our registration system and/or other unauthorized means; You are not allowed to maliciously register an account, including but not limited to frequent registration, batch registration of accounts, and other behaviors.
（5）Usually, your account is the unique identification for your activities on "ChatGenius". Unless otherwise agreed, each "ChatGenius" account can independently carry out activities on this website. However, in the following situations, we have the right to handle multiple "ChatGenius" accounts owned by the same and/or associated entities uniformly based on our own judgment. For example, based on the associated information of different "ChatGenius" accounts during registration, login, and use, "ChatGenius" determines that they are actually the same user. Examples of associated information include the same ID, phone number, payment account, device, etc.
（6）The ownership of the account belongs to Shanghai Jiuzhu Information Technology Co., Ltd. After completing the registration application procedures, the user only obtains the right to use the account, which belongs only to the initial applicant for registration. At the same time, the initial applicant for registration shall not gift, borrow, rent, transfer or sell the account, or otherwise license non initial applicants to use the account.
3、Account usage and security
(1) Users are responsible for ensuring the security of their registered account information and are legally responsible for any actions taken under their registered account. The user agrees not to disclose account information to others under any circumstances. When you suspect others are using your account, you should notify us immediately. You understand that it takes reasonable time for us to take action on any of your requests, and the actions we take at your request may not be able to avoid or prevent the formation or expansion of the consequences of infringement. You agree that, except for the legal fault of Shanghai Jiuzhu Information Technology Co., Ltd, we shall not be held responsible for this.
(2) According to national laws and regulations, you need to fill in your real identity information in order to use some functions of "ChatGenius". Please follow the prompts on the "ChatGenius" page to complete real name authentication and update relevant information in a timely manner.
Ⅳ、Account freeze, cancellation, and appeal
1、Account Freeze Your "ChatGenius" account (all or part of its permissions or functions) may be frozen in the following situations：
（1）Based on the needs of the operation and transaction security of "ChatGenius", if you encounter or may attempt to disrupt the normal service environment or transaction order of "ChatGenius", or use any affiliated company name or brand containing "ChatGenius" that is suspected of misleading others;
（2）Violation of this service agreement, relevant rules and regulations of "ChatGenius", and other service agreements/terms;
（3）Violating the provisions of national laws, regulations, policies, and legal documents, and infringing on the legitimate rights of others;
（4）If you have been complained about by someone else and they have already provided relevant evidence, but you have not provided the opposite evidence as requested by us;
（5）"ChatGenius" determines that your account operation is abnormal based on reasonable analysis；
（6）Freezing requested by competent authorities of the state；
2、If one of the following situations occurs during account cancellation, your "ChatGenius" account will be cancelled：
（1）Based on the account cancellation application submitted by yourself；
（2）When the situations listed above for account freezing occur and the situation is serious, or based on the requirements of the competent authorities of the country；
（3）When you have not logged into "ChatGenius" through your account for 12 consecutive months (including the account freeze period), "ChatGenius" has the right (but not the obligation) to cancel your account. You understand and agree that once your account is cancelled, you will not be able to perform other operations that rely on account permissions, and you will not be able to retrieve transaction records, historical information, etc. under that account. But account cancellation does not mean that all your account behavior and related responsibilities before the account cancellation are exempted or reduced. After the account is cancelled, we will have no right to continue collecting, storing, and using your personal information and data, except as otherwise required by laws and regulations. This does not affect the fulfillment of the relevant obligations of "ChatGenius" to confirm the true identity of the user before the account is cancelled in accordance with the requirements of regulatory authorities or other legal scenarios.
3、In case of account freeze or cancellation in the aforementioned case, you should pay attention to it in a timely manner and can send an email to jfk51667jjs@163.com for appeal. If you apply to us for the lifting of the above-mentioned freeze or cancellation, in order to ensure the security of your account, you should cooperate in providing truthful identification and relevant information, as well as other information or documents we require, for verification. You should fully understand that your appeal is not necessarily allowed, and we have the right to decide whether to agree to your appeal request. You understand and agree that if you refuse to provide truthful identification and related information, or fail to pass the review, we have the right to freeze the account for a long time and restrict some or all of its functions for a long time until the aforementioned situation is reasonably corrected or the account is cancelled.
Ⅴ、Software usage specifications
1. Before starting to use "ChatGenius", you fully understand and accept that the content generated by "ChatGenius" is generated through artificial intelligence technology. Due to technological limitations, "ChatGenius" may generate and output incorrect, offensive, and infringing content on third-party rights, even if it is output by a robot in a specific role. The content output by "ChatGenius" does not represent content recognized by Shanghai Jiuzhu Information Technology Co., Ltd.
2. To mitigate the potential risks of AI generated content, when you display or share content completed through "ChatGenius" to the public, you should prominently indicate that the content is generated by AI and will not cause confusion or misidentification among the public. You are not allowed to represent the content directly output by "ChatGenius" as artificially created or professional advice, such as providing medical treatment advice, financial advice, or legal advice without being reviewed by qualified personnel.
3. We have no obligation to "filter" the content you enter when using "ChatGenius" and related services, but we and designated personnel have the right (but not the obligation) to refuse or delete any content provided through the software or services at our own discretion.
4. By using "ChatGenius", you are deemed to understand and agree to the following terms:
(1) In order to provide you with effective services, "ChatGenius" will utilize resources such as the processor and bandwidth of your terminal device. During the use of "ChatGenius", there may be data traffic costs that users need to bear on their own.
(2) We will make reasonable commercial efforts to ensure the security of your data storage in the "ChatGenius" software and services. However, we cannot provide complete guarantees in this regard, including but not limited to not being responsible for the deletion or storage failure of your related data.
(3) Some features of "ChatGenius" may allow third parties to know the user's information. For example, after the user selects "ChatGenius" to communicate with other software or hardware information, other software or hardware providers may obtain relevant information that the user actively discloses on "ChatGenius". Before making a selection, the user should fully understand the product features and information protection strategies of other software or hardware.
(4) You personally authorize us to use the information you provide to "ChatGenius" and the information generated during the use of the services provided by "ChatGenius", in compliance with relevant laws and regulations, for the purpose of ① providing services, conducting market research and information data analysis by "ChatGenius" partners, who refer to commercial entities that cooperate with us in conducting business related to "ChatGenius" services. ② Conduct service improvement and artificial intelligence training.
(5) You personally authorize and agree that we may send and make commercial short messages or commercial phone calls related to "ChatGenius" to you, except as otherwise provided by laws and regulations. If you explicitly refuse or cancel such authorization, "ChatGenius" will stop sending commercial short messages or making commercial phone calls to you in accordance with the law.
Ⅵ、User behavior norms
1. You are entitled to enjoy the services provided by "ChatGenius". You shall also fulfill corresponding obligations and responsibilities in accordance with this agreement and the relevant terms and conditions confirmed by you when using specific services.
2. Standardized information content. When using the "ChatGenius" service, you should ensure compliance with national and local laws and regulations, industry practices, and social public ethics, and not use "ChatGenius" to input, create, copy, download, publish, or disseminate the following information or content:
(1) Political propaganda and/or news information that violates national laws, regulations, and policies, as well as national regulations;
(2) Involving state secrets and/or security;
(3) Subverting state power, overthrowing the socialist system, inciting division of the country, and undermining national unity;
(4) Promoting terrorism, extremism, feudal superstition, inciting regional discrimination, and regional hatred;
(5) Containing obscenity, pornography, obscenity, gambling, hatred, violence, and instigation to commit crimes;
(6) Violating national ethnic and religious policies;
(7) Engaging in activities that endanger network security, national security, honor, and interests;
(8) Insulting or slandering others, infringing on their legitimate rights and interests such as privacy, reputation, portrait, intellectual property, and trade secrets;
(9) Infringe the legitimate rights and interests of minors, harm their physical and mental health, induce their bad habits, etc;
(10) Distorting, vilifying, blaspheming, and denying the deeds and spirit of heroes and martyrs, and infringing on the names, portraits, reputations, and honors of heroes and martyrs;
(11) Fabricating, spreading rumors, false information, and other activities that are detrimental to social order, public security, public morality, and economic order;
(12) Any commercial purpose advertisement, proposal to sell or purchase any goods or services without explicit authorization;
(13) Impersonating any individual or organization, or making false statements or otherwise distorting your relationship with an individual or organization;
(14) Other information prohibited by laws, regulations, policies, public order and good customs. If you violate the above guarantees, we have the right to take measures such as deleting information, suspending services, and terminating services, as well as the right to freeze or cancel some or all functions of your account. You are responsible for any damages and/or losses caused to # # company # # or third parties.
3. Software usage standards. Unless permitted by law or with written permission from Shanghai Jiuzhu Information Technology Co., Ltd, you are not allowed to engage in the following activities with "ChatGenius" during use:
(1) Delete the copyright information on "ChatGenius" and its copies, and use, rent, lend, copy, modify, link, reprint, assemble, publish, publish, and establish mirror sites for the intellectual property owned by Shanghai Jiuzhu Information Technology Co., Ltd;
(2) Reverse engineering, reverse assembly, reverse compilation, or other attempts to discover the source code or underlying components of this software or service model for "ChatGenius";
(3) Develop basic models or other large-scale models that compete with "ChatGenius" using "ChatGenius";
(4) Extract data from services using any method, including network scraping, network collection, or network data extraction methods, Except for methods allowed by the API;
(5) Copy, modify, add, delete, hook up or create any derivative products for the data released into any terminal memory during the operation of "ChatGenius" or "ChatGenius", the interaction data between the client and server during the software operation, and the system data necessary for the operation of "ChatGenius", including but not limited to using plugins, plugins, or unauthorized third-party tools/services to access this software and related systems;
(6) Interference with "ChatGenius" and its components, modules, and data by oneself or authorized others;
(7) Other behaviors that violate laws and regulations, agreements and rules related to "ChatGenius", and infringe upon the legitimate rights and interests of Shanghai Jiuzhu Information Technology Co., Ltd and/or others.
4. Service usage standards. Unless permitted by law or with written permission from Shanghai Jiuzhu Information Technology Co., Ltd, you are not allowed to engage in the following activities while using the "ChatGenius" service:
(1) Creating false information, impersonating or using someone else's name, or disclosing someone else's personal information;
(2) Fictional facts, concealing the truth to mislead or deceive others;
(3) Infringement of legitimate rights such as reputation, portrait, intellectual property, and trade secrets of others;
(4) Using the account and any features, as well as third-party operating platforms, for promotion or mutual promotion without written permission from Shanghai Jiuzhu Information Technology Co., Ltd;
(5) Engaging in online hype, writing malicious software, and any illegal, irregular, or criminal activities using an account or this software and service;
(6) Produce, publish methods and tools related to the above behaviors, or operate or disseminate such methods and tools, whether or not these behaviors are for commercial purposes;
(7) Other behaviors that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of the software, or are not explicitly authorized by Shanghai Jiuzhu Information Technology Co., Ltd.
5、You are responsible for your actions. You fully understand and agree that you are responsible for all actions taken under your registered account, including any content you enter or upload in "ChatGenius", the production and training of personalized chatbots, and any consequences arising therefrom. You should make your own judgment and discrimination on the content output using "ChatGenius", evaluate any risks related to the content, including the accuracy, completeness, or usefulness of such content, and bear your own responsibility for the consequences of use. Shanghai Jiuzhu Information Technology Co., Ltd is not responsible for any damage caused by the user's use of "ChatGenius" content.
6、 Handling of breach of contract
(1) If we discover or receive reports or complaints from others that a user violates the provisions of this agreement, we have the right to delete or block the relevant content at any time without notice, and depending on the severity of the behavior, restrict some or all functions of the account of the violator until the provision of services is terminated or the account is permanently closed. We do not assume any responsibility for causing you to be unable to use the account and related services normally.
(2) You understand and agree that we have the right to impose penalties on users who violate relevant laws, regulations or provisions of this agreement based on reasonable judgment, take appropriate legal actions against any users who violate the law, and report and cooperate with relevant departments in accordance with laws and regulations. Users shall bear all legal responsibilities arising from this.
(3) You shall independently bear any third-party claims, demands, or losses arising from your use of the "ChatGenius" service, violation of this agreement, or any actions taken under your account. If this causes third-party claims against Shanghai Jiuzhu Information Technology Co., Ltd and its affiliated companies, employees, customers, and partners, you shall be responsible for handling and compensating Shanghai Jiuzhu Information Technology Co., Ltd and its affiliated company employees, customers, and partners for all losses and liabilities suffered as a result, including administrative penalties, damages, goodwill losses, settlement payments, and other losses.
Ⅶ、Protection of privacy and personal information
1. We will take reasonable measures to protect the personal information of users (i.e. information that can identify you independently or in combination with other information). Unless otherwise provided by laws and regulations, we will not disclose or disclose user personal information to third parties without the user's permission.
2. During the use of the "ChatGenius" software and services, you may need to provide your personal information (including but not limited to your phone number, location information, device information, etc.) in order for us to provide you with better services and technical support. We will protect your right to modify, delete relevant personal information, and revoke authorization in accordance with the law. For more information on personal information protection, please refer to the Privacy Policy published on "ChatGenius".
3. When you start using "ChatGenius", it is deemed that you agree to collect, store, use, process, transmit, provide, disclose, delete, disclose, and protect your personal information in accordance with the "Privacy Policy" published by "ChatGenius".
4. Please do not actively input your or others' personal information, especially sensitive personal information such as specific identity, medical and health, financial accounts, etc., when using functions such as robot conversations or creating personalized chatbots, to avoid personal information leakage.
Ⅷ、Intellectual property right
1. We respect intellectual property rights. If any organization or individual believes that the content of "ChatGenius" may infringe on their legitimate rights and interests, they shall submit a written notice of their rights. We will handle it as soon as possible in accordance with the law after receiving a qualified notice from the intellectual property rights holder.
2. Unless otherwise specified, the intellectual property rights of the logo, text, graphics, and their combinations of "ChatGenius", as well as other logos, logos, technical documents, etc. of "ChatGenius", belong to Shanghai Jiuzhu Information Technology Co., Ltd and its affiliated companies. "Intellectual property" includes any and all rights, ownership, and interests stipulated in laws such as patent law, copyright law, trademark law, and anti unfair competition law, as well as any and all applications, updates, extensions, and restorations thereof. Without the written consent of Shanghai Jiuzhu Information Technology Co., Ltd or relevant rights holders, you are not allowed to independently or license any third party to implement, utilize, or transfer the aforementioned intellectual property rights for any commercial or non-commercial purposes.
3. Shanghai Jiuzhu Information Technology Co., Ltd provides technical support for the development and operation of "ChatGenius", and enjoys all rights to all data and information generated during the development and operation of "ChatGenius" software and related services within the scope permitted by laws and regulations.
4. All content entered during the use of "ChatGenius" will not result in the transfer of intellectual property rights or other rights due to input behavior.
5. For the content you publish and upload through the "ChatGenius" software and related services (such as the personalized chatbot you create, excluding the dialogue content you enter), to the maximum extent permitted by law, you grant non exclusive, global, free, sub licensable, permanent, and irrevocable rights (including but not limited to reproduction rights, translation rights, assembly rights, information network dissemination rights, adaptation rights, and derivative production rights) to Shanghai Jiuzhu Information Technology Co., Ltd and its affiliated companies and inheritors. We have the right to use or license third parties to use and otherwise develop content in any promotion, advertising, marketing, and/or research related to the "ChatGenius" software and related services, Shanghai Jiuzhu Information Technology Co., Ltd, and/or its brand.
10. Based on certain features, the content you publish through the "ChatGenius" software and related services (such as personalized chatbots you create and set as public) can be used by other users.
Ⅸ、Scope of Liability and Limitations of Liability
1. Within the scope permitted by applicable laws, Shanghai Jiuzhu Information Technology Co., Ltd shall not be liable for any indirect, punitive, special, or derivative losses related to or caused by the "ChatGenius" software and services. Unless otherwise specified by laws and regulations, our full responsibility to you, regardless of the reason or behavior, shall not exceed the fees (if any) paid to us by you during the use of the "ChatGenius" software and related services.
2. Under no circumstances shall Shanghai Jiuzhu Information Technology Co., Ltd assume any responsibility for the actions, content, or materials of any third party. The review of personalized chatbots created by users is preliminary and limited. The robots that have been approved and made public do not represent any recognition or guarantee of their output content. If the personalized chatbot created by the user violates laws and regulations, infringes on the legitimate rights of others, or is prohibited by this agreement, you can report it by sending an email to jfk51667jjs@163.com. After verifying the situation, we will take necessary measures such as deleting, blocking, and disconnecting links.
3. "ChatGenius" may use third-party software or technology (including open source code and public domain code that may be used, etc.). Any disputes arising from the use of third-party software or technology in this software shall be resolved by the third party, and Shanghai Jiuzhu Information Technology Co., Ltd assumes no responsibility ##Company## does not provide customer service support for third-party software or technology. If you need support, please contact the third party.
Ⅹ、Changes, interruptions, and termination of services
1. "ChatGenius" is provided according to the current technology and conditions that can be achieved. "ChatGenius" will make every effort to ensure the continuity and security of the service, but cannot foresee and prevent legal, technical, and other risks at any time. Within the scope allowed by law, if the service cannot be provided normally due to the following reasons, we will not assume any legal responsibility:
(1) Force majeure refers to objective circumstances that both parties cannot foresee, and its occurrence and consequences are insurmountable and unavoidable, including but not limited to the following situations: natural disasters such as floods, hail, tsunamis, typhoons, droughts, fires; Social factors such as strikes, riots, wars, epidemics, and applicable policies, laws, and regulations that prevent compliance;
(2) Due to public service factors such as power supply failures and communication network failures;
(3) Due to hacker attacks, viruses, abnormalities in your own software and hardware devices, etc., which are not the sole responsibility of "ChatGenius";
(4) Short term system maintenance (including but not limited to troubleshooting, system upgrades, system expansion, server migration)
2. You understand and agree that we have the right to decide on the settings and scope modifications of services/features based on the situation, the right to choose the objects to provide services, the right to decide on the objects and scope of feature openness, data interfaces, and related data disclosure, and the right to interrupt, suspend, or terminate the "ChatGenius" software and related services.
3. We have the right to decide to use this software for commercial purposes, including but not limited to developing, using some services of this software for third-party promotion, etc.
XI、The validity, interpretation, amendment, enforcement, and dispute resolution of this agreement shall be governed by the laws of the mainland of the People's Republic of China (excluding conflict of laws). Any disputes or controversies arising from this agreement shall be resolved through friendly consultation; If negotiation fails, the dispute or controversy shall be submitted to the people's court with jurisdiction over the defendant's domicile for resolution through litigation.
XII、Notification delivery
1.
